These Rules apply whenever a user offers, requests, discusses, or carries documents or goods through a connection made on On Your Way. They form part of the Terms of Service. On Your Way does not certify that an item is legal or safe.
1. User responsibility
- The sender/requester must accurately disclose the contents, condition, quantity, value, ownership, purpose, and any special handling or legal requirements.
- The sender/requester is responsible for suitable packaging, labeling, permissions, declarations, and instructions.
- The traveler/courier must independently decide whether to accept an item and must comply with all origin, transit, destination, customs, sanctions, aviation, carrier, licensing, tax, and import/export rules.
- Both users must provide truthful documents, verify the intended recipient, and cooperate with lawful inspection. Do not accept or hand over an item if its contents, owner, recipient, purpose, or legality are unclear.
2. Prohibited items
You may not use the service for any item or document whose possession, transport, export, import, transfer, or delivery is unlawful or restricted without required authorization. This includes, where prohibited or unauthorized:
- Illegal drugs, controlled substances, drug-production materials, and unlawfully supplied medicines.
- Weapons, ammunition, explosives, incendiaries, hazardous materials, poisons, radioactive materials, or dangerous chemicals.
- Stolen, counterfeit, pirated, fraudulent, or illegally obtained goods or documents.
- Human remains, trafficked wildlife, protected species, or goods made from them.
- Items connected to trafficking, terrorism, sanctions evasion, money laundering, fraud, or other crime.
- Any goods barred by applicable customs, sanctions, aviation, postal, carrier, or destination rules.
3. Documents, money, medicine, and regulated goods
Personal documents, identity documents, money, valuables, medicine, food, alcohol, tobacco, electronics, batteries, cultural property, commercial quantities, and other regulated goods may carry substantial legal and safety risk. They are not categorically banned by this policy where lawful, but users must confirm legality, authorization, insurance, declarations, and handling requirements before proceeding.
4. Disclosure and inspection
Users must not conceal or misdescribe contents. A courier may request reasonable proof, packaging changes, or inspection where lawful, and may refuse or stop a delivery at any time. Sealed packaging does not transfer legal responsibility to On Your Way or guarantee acceptance by a traveler, carrier, customs authority, or destination.
Users arrange each handover and delivery at their own risk. On Your Way and its platform service providers do not take custody of, transport, insure, track, or guarantee cargo or documents and are not responsible if an item is not handed over or transferred, or is delayed, rejected, misdelivered, damaged, lost, stolen, confiscated, seized, or destroyed, except where liability cannot legally be excluded.
5. Handover, payment, and failed arrangements
- Users must agree directly on pickup and delivery times and locations, identity verification, the correct recipient, item condition, proof of handover, payment, and cancellation terms.
- Do not leave items unattended or hand them to an unverified or unintended person. On Your Way does not verify recipients or provide tracking or proof of delivery.
- Recipient refusal, no-shows, failed or partial handovers, return arrangements, storage, disposal, and recovery of items are solely the participating users' responsibility.
- User-to-user deposits, payments, non-payment, chargebacks, refunds, expenses, and compensation claims are solely between the participating users. On Your Way does not collect or guarantee them.
6. Customs, costs, insurance, and external events
Users are responsible for taxes, duties, declarations, licenses, inspections, fines, penalties, storage charges, return costs, and other consequences imposed by authorities or third parties. On Your Way does not provide insurance or compensation. Users should obtain appropriate insurance where available and understand that weather, accidents, strikes, border closures, carrier restrictions, governmental action, and other external events may prevent or affect a delivery.
7. Reporting
Do not proceed if you suspect an item is illegal, dangerous, misrepresented, or connected to harm. Report the offer or user in the app and contact appropriate authorities where necessary. For safety assistance or policy questions, use in-app support or email bitsoasis@web.de.
8. Consequences
Violations may result in offer rejection/removal, suspension, account termination, preservation of records, and disclosure to authorities where legally permitted or required.
